Federal Judge Blocks Implementation of $100,000 H-1B Visa Application Fee

On June 8, 2026, a federal court blocked the Trump Administration from implementing a $100,000 fee for all new H-1B visa applications. This proposed fee was announced as a proclamation by the Executive Office of the President on September 19, 2025, entitled, Restriction on Entry of Certain Nonimmigrant Workers. The court ruled that the fee constituted an unlawful tax which was not authorized by Congress. It remains to be seen whether the Administration will appeal this decision or request a stay on the ruling.
